Terms and Conditions
when using MISpay

By accessing our website, you are agreeing to be bound by these terms of service, and agree that you are responsible for compliance with any applicable local laws.

Terms and Conditions

  1. These Terms and Conditions shall constitute a legally binding agreement concluded between you (whether in person or on behalf of an entity you represent) and Excellence Technologies for Applications Solutions for Information Technology (MIS Pay) hereinafter referred to as (“We”), with regard to all aspects of payment services that are provided and/or accessed through the platform https://www.mispay.co/ or MIS Pay application, in addition to any other media format, media channel, website, or mobile application related to, or accessed through, access to and use of the Platform. You acknowledged that you read, understood, and agreed to be obligated by these Terms and Conditions, as amended from time to time. If you use the Platform on behalf of a third party, including any business entity, you declare that you are authorized and have the authority to obligate such third party to these Terms and Conditions.
  2. The merchant from whom you purchase Goods or Services through MIS Pay Payment Services is not a party to this agreement, and any applicable terms between you and the merchant are independent of the conditions of this agreement.
  3. We are entitled to, at our sole discretion, change or amend these Terms and Conditions at any time and for any reason.
  4. You acknowledge your responsibility to review these terms and conditions periodically to review the latest updates, and you shall be notified of any update to the terms and conditions by text messages. Your continuing use of the platform or application after the date of publication of the revised terms and conditions shall be deemed an acknowledgement by you that you reviewed the amendments, understood the content, and accepted to be obligated by them.
  5. This preamble shall be an integral part of this agreement.

6. Definitions:

The following signs, words, expressions and terms shall have the meanings indicated opposite each of them in these Terms and Conditions:

6.1 References to the pronoun “You”: In this agreement, references to the pronoun “You,” the possessive pronoun, or any other similar pronouns mean the relevant customer referred to in the identification information (as defined below) required prior to using the services payment from MIS Pay as specified below.

6.2 References to the pronoun “We”: References using the pronoun “We” or the plural noun as a possessive or plural pronoun or any similar pronouns in this agreement mean Excellence Technologies for Applications Solutions for Information Technology (MIS Pay) its affiliated entities and persons.

6.3 Platform: means the E-platform of Excellence for Application Solutions for Information Technology (MIS Pay) https://www.mispay.co/ .

6.4 Customer: means the customer of the “Merchant or Merchant Platform” who uses the (MIS Pay) account.

6.5 Merchant: means any commercial entity that provides payment services from (MIS Pay) to its customers according to an agreement between it and (MIS Pay), or between (MIS Pay) and the merchants platform.

6.6 Merchant Platform: means any methods, including but not limited to websites and applications that allows multiple merchants to offer goods and services to customers through a single platform.

6.7 Services: means the services provided by Excellence Technologies for Application Solutions for Information Technology (MIS Pay).

6.8 Purchase order: means the request submitted by the customer through the E-platform, the merchant’s website, or any applications, or other point of sale to use the payment service from (MIS Pay) to purchase goods or services from the merchant.

6.9 Payment service from (MIS Pay): means the service specified by the customer at the merchant or on the website of the merchants platform or at any other point of sale at the merchant or on the merchants platform under which the customer chooses to purchase goods or services from the merchant or the merchants platform using the service (MIS Pay) subject to this agreement.

6.10 (MIS Pay) account: means the account created by the customer to use the payment service from (MIS Pay), the use and operation of which shall be subject to the terms and conditions of this agreement.

6.11 Payment: means the process that the customer goes through when choosing to use the services payment available through the platform (MIS Pay) in relation to a specific purchase order.

6.12 Refund: means an amount paid by a customer to a merchant via MIS Pay in connection with an approved transaction and subsequently returned to the customer following a dispute.

6.13 Dispute: means any request for refund, discount, compensation, counterclaim, or dispute of any kind by the customer against the merchant in relation to the goods or services that led to an authorized transaction.

6.14 Identification information: means the information required to be provided by the customer to (MIS Pay) in order to create an account for it with (MIS Pay) as collected by (MIS Pay) or the merchant or merchant platform for the purposes of providing payment services from (MIS Pay) for customers.

6.15 Total amount: means the total amount to be paid by the customer (including any value added tax, shipping charges and service charges) in respect of a purchase order that results in one approved transaction less:

6.15.1 Any returns

6.15.2 Any discounts, credits or discounts requested by the customer and approved by the relevant merchant

6.16 Force Majeure: means any fate event or sudden accident that cannot be expected and impossible to prevent, including, in general, but not limited to fire, floods, storms, hurricanes, whirlwinds, volcanic activities and earthquakes, in addition any actions, orders or requests issued by a sovereign authority or government and/or any other authority that is supposed to work for the benefit of that party, in addition to war, whether declared or not, and actions similar to war, revolutions, riots, civil disobedience, civil unrest, as well as strikes, work stoppages, and /or similar situations, and any other similar cause beyond the control or control of any party, unless its execution is a warranted performance under an express waiver of relief in the event of a Force Majeure event.

6.17 Applicable Laws: means the laws in force in the Kingdom of Saudi Arabia that apply to the agreement.

7. Competence and validity

7.1 Your use of payment services from (MIS Pay) indicates that you have the legal competence to conclude this agreement, these terms and conditions, and that you are over the age of eighteen (18) years.

7.2 If you register as an employer, legal person, or any other entity, then it is an acknowledgment from you that you have the power and capacity necessary to conclude this agreement and to bind your entity to these terms and conditions. You shall also comply with all applicable laws and requirements that apply to, and are subject to, the process of using the electronic platform and using payment services from (MIS Pay).

7.3 By selecting to agree to the terms and conditions of this agreement, you acknowledge that you have concluded this agreement electronically in accordance with the applicable regulations in the Kingdom of Saudi Arabia.

8. Accounts and registration:

8.1 The process of registering the account and completing the agreement requires you to submit to (MIS Pay) certain personal information for KYC purposes applicable in the Kingdom of Saudi Arabia, including but not limited to full name, address, e-mail, phone number, age.

You acknowledge and agree that true, accurate, complete, and up-to-date information about you shall be maintained on the Account, and you shall notify MIS Pay immediately of any changes to your identifying information or any other information or circumstances that may affect your eligibility to continue using the MIS Pay Payment Services or as otherwise required pursuant to the terms and conditions of this agreement.

8.2 You hereby agree to disclose all information that may be affecting or of importance to any party to the post-paid agreement.

8.3 You hereby agree to be responsible for all activities that occur under your account. You also hereby agree to maintain, at all times, security measures on your account username and password, unless otherwise stated by MIS Pay in writing.

8.4 If your password is lost or stolen, or if you believe that there was unauthorized access to your MIS Pay account, then you shall change your account password and notify us immediately. The customer shall be responsible for any transactions made using its stolen account unless the customer immediately notifies us of the account suspension and receives text messages or emails from (MIS Pay) stating that the account was closed.

8.5 It is not permissible to transfer user accounts. Therefore, you acknowledge and agree to refund to (MIS Pay) the value of any operation of using your account, provided that it shall not be a valid operation or authorized or applicable according to the law and that happened on your part or on the part of any person that may access to the electronic platform, services or otherwise by using your username or password, whether or not you allow such access.

8.6 If (MIS Pay), at its sole discretion, has any doubts that any of the provided information is incorrect, inaccurate, incomplete or out-of-date without prejudice to any other rights, in accordance with these terms and conditions or under Applicable laws, then we are entitled to suspense our services and suspense your access to the electronic platform or its services or limit this access.

8.7 (MIS Pay) may, at its absolute discretion, and at any time express any inquiries it deems necessary, whether this is done directly or through a Third Party. (MIS Pay) may request you to submit a response with more information or documents without limitation to what was mentioned above. If you are an employer or are registered on behalf of an employer, this information or documents may include the commercial registry and other official documents of the company or documents that include any validity guaranteed to anyone to act thereunder. You acknowledge and agree to provide any information or documents to (MIS Pay) upon request. You further acknowledge and agree that if you are unable to do so, (MIS Pay) may, without any liability, restrict, suspend or withdraw your access to the Online Platform. We also reserve the right to suspense any unconfirmed or unverified accounts or any accounts that were not active for a long time.

8.8 Upon your completion of the registration process, you agree that you read the following terms and conditions understood them and agreed to adhere to them, in addition to the privacy policy and even all that may be modified from time to time. The policy and its amendments, according to this agreement, shall be an integral part and even included in these terms and conditions.

9. Services:

9.1 (MIS Pay) is an electronic platform designed to be a link as a comprehensive commercial center for many large commercial stores by contracting with the owners of these sites or stores. Our goal shall be to provide a guide for major commercial stores and give the customer the advantage of buy now, pay later option.

9.2 The (MIS Pay) website presents the companies that provide products provided and owned by merchants on their own platforms and they agreed to put a list of these companies on the electronic platform. These merchants agreed in writing with (MIS Pay) to provide the products subject matter to orders through their electronic platforms.

9.3 The merchant does not have the right to impose any additional fees on the purchase amount. Please make sure to review the value of the purchase amount. If any fees are imposed, the fees are not in the interest of (MS Pay) and are not subject to its approval.

10. Correspondence and Electronic Communication:

10.1 When you create an account, you hereby acknowledge and agree that you may communicate with us electronically and accordingly you agree to receive periodic messages from us and the MIS Pay team may contact you via e-mail or send you information via SMS or through any means other communication. Post notices on the Platform as part of the normal business conduct of your use of the Services.

10.2 To ensure the communication with you electronically, you agree to notify us immediately of any change in your email address or other information you provide to us and we would contact you accordingly, including your phone number by updating your identifying information and any other information related to your account at (MIS Pay) as soon as practicable and when necessary.

10.3 You hereby acknowledge and agree that all agreements, notices, disclosures and other provided electronically communications are communications that fulfill any legal requirement. Such correspondence shall be submitted in writing.

10.4 The (MIS Pay) platform may also ask you during the registration process to agree to send you E-mails or promotional notifications related to the electronic platform and its services. You hereby agree to receive SMS messages for each phone number you provide to (MIS Pay). You hereby acknowledge that you are the main user of the phone number provided to us. You are permitted to receive an SMS at the phone number provided to us. You also agree to alert us whenever you stop using a particular phone number.

11. Intellectual property rights and trademarks:

11.1 With regard to all content contained on the electronic platform, including in general, but not limited to text, graphic images, (MIS Pay) logos, buttons, images, audio clips, digital downloads, information, collection and electronic programs, then such content shall be a property and a private authorship of (MIS Pay). The content on the electronic platform shall be an exclusive property of (MIS Pay) and even copyright and shall be subject to protection by copyright, trademark rights, patents and other intellectual property rights and laws.

11.2 The (MIS Pay) mark and associated symbols shall be trademarks of (MIS Pay), noting that it is not permissible to use the (MIS Pay) trademarks in connection with any product or any service not shown on the (MIS Pay) platform, or any product or service that discredits MIS Pay or harms its reputation.

11.3 The customer shall be prohibited from using any trademark or any intellectual property rights belonging to (MIS Pay) from any part of the services. The customer shall be prohibited from reproducing or modifying the services or making any process of preparing, publishing, executing, sending, displaying, broadcasting or other means of exploiting the services, unless (MIS Pay) allows it or authorizes it expressly and in writing. It is not permissible to perform dismantling of the services system or any reverse engineering or reshaping of it or link any part of the services to any system reflect or place any programs or scripts for the purpose of removing, indexing, deleting or otherwise performing any information extraction operations on any part of the services, or unduly overloading the operation or functionality of any aspect of the services or attempting to obtain access to it without authorization or working to harm the services or related systems or networks.

12. Using the E-platform:

12.1 The customer is prohibited from using the E-platform of (MIS Pay) to advertise for its product or in any other place on the platform, as determined and according to our absolute choice in any publishing process for the following: any advertising for attraction, any advertisements, the use of vulgar language, obscene materials, contains insults, transgressions from a cultural, religious point of view, any critical political content, materials that threaten the public interest, national security, cause offense, slander, defamation, any other content that may be insulting, obscene or inappropriate.

21.2 We are entitled to refuse any transactions for any reason at our sole discretion. We are not responsible for any rejection of your account or refusal to execute any transaction.

13. Product lists and their availability:

13.1 (MIS Pay) shall always work to provide you with the best experiences, and even an outstanding level of service, as (MIS Pay) makes every effort to ensure that the merchant’s products are available and disposable, but (MIS Pay) bears no responsibility in the event that no products are available at any merchant, these products were offered on the E-platform .

14. After-sales services for the products:

14.1 The products sold by term payment (MIS Pay) through this E-platform that non-bearing the trade name of (MIS Pay) are products for which services and support are provided by merchants, their manufacturers or local agents only, in addition to their suppliers, according to terms and conditions associated with each product. Likewise, (MIS Pay) does not grant any warranty of any kind with regards to the products sold on the E-platform. Therefore, please contact merchants if you need technical support, customer service or after-sales service with regard to their products.

15. Payment:

15.1 Once you create an account with (MIS Pay) according to this agreement, (MIS Pay) grants you the ability to request the use of (MIS Pay) payment services when you choose to pay for goods or services using the payment option of (MIS Pay) payment services at the concerned merchant or on the E-platform of the merchants platform.

15.2 Payment Services from (MIS Pay) allow you to purchase goods or services from a merchant or merchant platform with payment at a later time based on the payment terms specified during the payment process as specified in the payment process through concluding this Agreement, you agree and acknowledge that you may understand and accept all fees associated with your purchase order as specified in the payment process.

15.3 Once you choose the payment service from (MIS Pay) at the point of sale of the merchant during the payment process, you shall be asked to choose from a set of payment terms, if any, that shall become valid and binding between you and (MIS Pay) with regard to this purchase order. (MIS Pay) provides various payment methods on the E-platform, including electronic payment through credit cards.

15.4 (MIS Pay) reserves the right to make any change or modification in the payment methods or the process of its availability.

15.5 (MIS Pay) provides electronic payment services through third party service providers, knowing that (MIS Pay) bears no responsibility for any error, damage, or any similar matter that the customer may be exposed to as a result of or as a result of using the electronic payment method. As it is the responsibility of the third party service provider.

15.6 The customer shall ensure that there is sufficient financial coverage in the relevant account, so that orders can be covered, and the customer shall adhere to the limits of credit card transactions.

15.7 According to this agreement, you, the customer, agree and authorize (MIS Pay) to withdraw the amount from the card account stored in (your own account) with (MIS Pay) on the due date for payment. You agree to save your data with us or with our approved service providers with Considering and adhering to what is stated in the “Credit Information” system, MIS Pay has the right to withdraw the amounts due on the due date from the stored card account. If the direct debit process for the instalment or the total amount due fails, you must make the required payment immediately. You must ensure that there is enough for your required entitlements.

15.8 (MIS Pay) may, at its absolute discretion, at any time, express any inquiries it deems necessary, whether directly or through third parties, and it may also ask you to provide it with more information or documents, including in general but not limited to any information or documents required to verify your identity and/or financial solvency. You acknowledge and agree to provide any information and/or documents to (MIS Pay) upon request. You also acknowledge and agree to acknowledge and agree that if you are unable to do so, (MIS Pay) may, without any liability on it, cancel the transaction, restrict or stop your access to the E-platform and/ or withdraw your membership from it.

15.9 According to this Agreement, you acknowledge to your financial solvency and your ability to fulfill all financial obligations to (MIS Pay), and you also agree to your prior knowledge that (MIS Pay) is entitled to cooperate with the merchant, the service provider or the goods, in the event of your default. This cooperation may include suspending the subscription or service, seizing the product or the goods until the payments are completed.

15.10 According to this Agreement, you agree to authorise us to check your credit history, in order to obtain and maintain your credit report, and to verify your identity via National Unified Access (NAFATH) or any other relevant data sources. You also acknowledge that your credit report may affect the acceptance of your request for payment with (MIS Pay), depending on your credit behavior and payment history. (MIS Pay) may also have to share information about your credit history or any other information to the Saudi Credit Bureau (SIMAH) or any other entity approved by the Central Bank of Saudi Arabia (SAMA).

15.11 You hereby agree that you understand and bear the potential consequences when you use the postpaid service in contravention of the agreed terms. You agree that (MIS Pay) is entitled, at its sole discretion, to notify the Saudi Credit Information Company (“SIMAH”) in the event of your delay or default.

 

15-12 You agree in accordance with SIMAH’s declaration, which states: “I, the undersigned, declare that my personal data and information are true, accurate, and complete, and therefore I acknowledge my agreement to authorize (MES Pay) to establish and/or create and/or inquire and/or issue and/ Or review my credit record with the Saudi Credit Information Company (SIMAH) and disclose my previous, current and future credit information and data and share them with all current and potential members of the Saudi Credit Information Company (SIMAH) or to any party approved by the Central Bank of Saudi Arabia.”

 

15.13 You hereby agree that you are the real beneficiary of this agreement and that you do not use (MIS Pay) services in any money laundering operations or fraud or liquidity operations.

16. Refund:

16.1 (MIS Pay) shall not be liable to you in connection with any refund process, while (MIS Pay) may play a role in facilitating refunds and Money back between you and the Merchant or Merchant Platform at its sole discretion, such role does not involve assume no liability in connection with refunds.

17. Confidentiality and privacy:

17.1 (MIS Pay) is committed to all reasonable professional methods in maintaining the confidentiality of credit information and data in its possession, and not to use or exchange it between it and the relevant persons and parties except within the limits and according to the items stipulated in the credit information system and its executing regulations.

17.2 You hereby agree to provide any information, including identifying information or documentation, reasonably required by (MIS Pay) to verify your identity with regard to your (MIS Pay) account or any use of (MIS Pay) services, and authorize us to make any inquiries we believe necessary to verify your identity. (MIS Pay) reserves the right to close your (MIS Pay) account or suspend or limit your access to (MIS Pay) payment services if we are unable to obtain or verify any such information to our satisfaction.

17.3 You hereby agree to and authorize (MIS Pay) to use any or all Identification information and your personal data collected through the online platform, platforms, or mobile applications of (MIS Pay) or the trader from time to time. It may be used or disclosed to third parties, this may include sharing your Identification information and any other information with third parties for the purposes of credit checks, anti-money laundering checks, or other similar checks, or for any other purpose that MES Pay may deem necessary to enable (MIS Pay) to provide payment services to you and to comply with all applicable laws and regulations.

17.4 You hereby agree, upon accessing or using the online platform or mobile applications of (MIS Pay) to the Privacy policy, knowing that your personal information shall be collected and understanding how it shall be handled.

17.5 If you do not agree with our policies and practices, you shall not be able to use the online platform services or mobile applications of (MIS Pay).

17.6 (MIS Pay) shall not allow the customer (contracting with (MIS Pay) to disclose to third parties any information received under this agreement or a service contract concluded with (MIS Pay), and any information related to (MIS Pay)’s business shall not be accessed. MIS Pay) in a manner that shall include privacy within the limits that may negatively affect the business of (MIS Pay), and the customer shall be responsible for compensating (MIS Pay) for any loss in business or reputation, if this occurred as a result of any action taken by the customer.

17.7 (MIS Pay) shall not be responsible for any misuse of your personal account if you authorize anyone to use your personal account information or your registration information to perform transactions through your account, and accordingly, you shall be responsible for all transactions made on your account, and you shall acknowledge and agree However, you shall not hold us responsible for the consequences of the actions of any third party that you allow to use your account.

18. Limitation of liability

18.1 (MIS Pay) is an independent platform that shall not participate in transactions between customers, traders, sellers, or other related transactions, and (MIS Pay) shall not be responsible in any way for any situation related to traders and shall not be responsible for any failure of traders products, their type, brand, reliability, efficiency, originality, availability, or legality.

18.2 Third-party traders under this agreement shall be independent service providers and contract only with (MIS Pay), and they shall not be considered employees of (MIS Pay) or its representatives or agents. Also, (MIS Pay) shall not perform the tasks on its own, it manages the process of carrying out tasks through its electronic platform by providing a communication process between the customer and the trader, and the traders shall be responsible for all transactions that take place between them and customers or other related transactions, and if a dispute arises between any of the participants in these transactions, each of the customers, users, and traders undertake to exempt (MIS Pay) from any responsibility resulting from or related to any disputes between any party in any way. And undertake to exempt (MIS Pay) and its agents and employees from claims, demands, responsibilities, and compensations of whatever kind or nature, whether known or unknown, disclosed or undisclosed, arising out of or in any way connected with such disputes.

18.3 Subject to the approval of this Agreement, you acknowledge and understand the possibility of risks or mistakes from traders or from third party service providers. Therefore, the use of services shall be the responsibility of the customer according to its decision, and (MIS Pay) shall not be responsible for it.

18.4 (MIS Pay) shall not be liable to you or any other person for any direct, indirect, incidental, special, penal, punitive, or consequential damages that may arise, even if (MIS Pay) is advised about the possibility of such damages. (MIS Pay) shall not be liable for any damages, liabilities, or losses incurred by you arising from your use or reliance on the services, as a result of your inability to access or use the services, or from any transaction or relationship that arose between you and any merchant, even if (MIS Pay) was informed of the possibility of such damages. (MIS Pay) is also not liable for any delay or failure to implement, nor is it liable in the event that the merchant does not possess a professional or specialized permit to work.

18.5 The services are provided as they are offered and as available from them, and (MIS Pay) is exempted and disclaimed from all disclaimers, explicit or implicit, or legal warranties that are not expressly stated in these conditions, including the implicit warranties regarding the seller’s ability and suitability of its services for a specific purpose and without prejudice to it, nor does (MIS Pay) provide any disclaimers or warranties regarding the credibility, quality, sustainability, availability, or original owner of the services or goods, or any services requested through the use of the (MIS Pay) service, nor does (MIS Pay) warrant that the services are uninterrupted or error-free. You hereby decide and agree that you shall exclusively bear all responsibility arising from your use of any of the services offered by (MIS Pay), to the fullest extent permitted by the applicable law.

18.6 The information contained in the electronic platform is presented for general purposes only. As for the information received by (MIS Pay), we make every effort to ensure that the information remains updated and correct, but we do not make any disclaimers or warranties of any type, whether verbally or implicitly, in terms of the completeness, accuracy, reliability, suitability, or availability of the electronic platform, information, services, or related advertisements or graphics contained on the electronic platform for any purpose. Therefore, your reliance on such information is entirely at your own risk.

18.7 All accounts registered on (MIS Pay) are considered to be continually monitored accounts, for security and performance reasons.

18.8 (MIS Pay) shall not be responsible for any delay, obstruction or failure to provide services, if the reason for it is due to a force majeure event or similar events beyond our control or governance and that prevent or impede the process of providing the service.

18.9 You hereby acknowledge and agree to release from liability, compensate and waive of liability of (MIS Pay)and any of its affiliates, officers, directors, employees and agents from and against any and all claims, liabilities, damages, losses or expenses, including but not limited legal and accounting fees arising out of or in any way related to the following:

18.9.1 Your access to the (MIS Pay) account, its payment services, using it, or inability to use it.

18.9.2 Your negligence or misconduct.

18.9.3 Your violation of any applicable law.

18.9.4 Your failure to provide and maintain true, accurate, current and complete information related to your (MIS Pay) account.

18.10 If you do not agree to any of these terms and conditions in the Agreement, you shall not access the (MIS Pay) platform and not use its services.

19. Compensation:

19.1 You acknowledge and agree to compensate and hold harmless of (MIS Pay) , its affiliated entities, sponsors, partners, directors, officers and employees and reimburse them for all losses, liabilities, claims, judgments, settlements, fines, costs and expenses (including any expenses, legal fees, investigative costs and attorneys’ fees). if (MIS Pay) suffers any damages caused by you or if it arises from or related to your breach of the Agreement, these terms and conditions or the Privacy Policy, or your use or the use of a third party (by your party) of the Services.

20. Undertakes

20.1 This clause is notice to you stated that, in accordance with these Terms and Conditions, we pledged all of our rights and benefits, the right to deduct any amount payable by you. Accordingly, MIS Pay shall be qualified to be entitled to exercise all of its rights and power of discretion and remedies and shall pay any amount payable by you, unless it receive written notice other than that. In this case, you are entitled to claim all rights, powers, discretions, and remedies, under a notice, whereas, once you accept to these terms and conditions, you acknowledge and accept the terms of this clause.

20.2 You also acknowledge that you have no connection to any criminal activity or fraud or liquidity operations money laundering and acknowledge that the due amounts under the deferred payment decision shall be from legitimate revenue and shall not be obtained from any illegal activity.

20.3 You acknowledge that neither you nor any of your relatives, guarantors, or employees is not in whether in the government/ private/ military sector (relevant). Additionally, you undertake to notify (MIS Pay) in the future of any changes that may occur in this regard, so that it is entitled to obtain the necessary approvals in this case.

21. Notifications

21.1 In accordance with the terms hereof, all notifications and other correspondence under this agreement shall be sent in writing via the e-mail of (MIS Pay) indicated on the (MIS Pay) E-platform or you shall communicate with it via the unified number during official work hours or otherwise. If (MIS Pay) wishes to communicate with you, it shall communicate with you via your e-mail or text messages on your phone number that you provided to (MIS Pay) or any other means of communication.

21.2 To ensure that we be able to communicate with you electronically, you shall agree to notify us immediately of any change to your email address or other information you provide to us and we shall communicate with you via them including your phone number, by updating your identifying information and any other information related to your personal account at (MIS Pay) as soon as practicable and when necessary.

22. Early payment

The Customer is entitled to pay all dues early (total amount).

23. Cooperate in actualizations and inquiries:

23.1 You hereby agree to cooperate with (MIS Pay) to the fullest extent permitted by applicable law and regulations in the Kingdom of Saudi Arabia, including approving to answer in writing any questions or provide information to assist (MIS Pay), In conducting any internal Actualizations or inquiry.

23.2 You hereby acknowledge that you agree that your information and your mentioned account or any other account may be disclosed by (MIS Pay)

Under this agreement, you acknowledge that you agree to disclose (MIS Pay) your information and your mentioned account or any other account of that the proxy of the Saudi Credit Bureau (SIMAH) through the concluded membership agreement and business rules for the exchange of information and/or any Other party approved by the Saudi Central Bank (SAMA).

24. Independence and severability of the terms and conditions

24.1 If the invalidity of any condition or term is decided in this agreement, then only that condition or term shall be considered invalid without affecting in any way the rest of the terms and conditions that remain valid and effective.

25. Validity and Termination of the Agreement:

25.1 This Agreement shall become effective on the date on which you click to indicate your acceptance of its terms and shall remain in force and effect for the heirs.

25.2 If (MIS Pay) decides to terminate this Agreement, it shall notify you by sending a notice to the e-mail address you provided to (MIS Pay. You also hereby agree and acknowledge that (MIS Pay) is entitled to terminate this Agreement with or without reason with no obligation to notify you of the reason for termination of the Agreement.

25.3 You may terminate this Agreement after confirming that you have paid all dues by closing your (MIS Pay) account by following the instructions on the (MIS Pay) E-platform. For the avoidance of doubt, you shall remain liable for all liabilities relating to your (MIS Pay) account even after it has been closed and you have terminated this Agreement.

26. Entire Agreement:

26.1 The Agreement and all the terms and conditions contained therein represent the entire agreement and what has been agreed, accepted and understood between you and (MIS Pay). The Agreement also includes what may be updated from time to time and what is published in this regard on our E-platform, and this agreement supersedes and extinguishes all or any earlier agreements of any kind.

26.2 These terms and conditions constitute notice to you that all rights, interests, and property of (MIS Pay) have been stated, including the right to deduct any amount payable by you in accordance with these terms and conditions. (MIS Pay) shall remain eligible to exercise all of its rights, discretion and remedies under these terms and conditions.

26.3 Hereby, I, the undersigned, agree to provide Excellence Technologies for applications solutions for information technology (MIS Pay) with any information you require from me to establish my account with the company and/or to review and/or manage it, and I authorize the company to obtain the necessary or needed information related to me or my aforementioned account or any other account that the company has from the Saudi Credit Bureau (SIMAH) through the concluded membership agreement and the approved work rules related to the exchange of information and/or any other entity approved by the Saudi Central Bank (SAMA).

26.4 You agree, subject to aforementioned, that you understand and responsible to the probable consequence when using the financial services to breach the agreed conditions. You agree that (MIS Pay (has the right to inform the Saudi company of the credit information “SIMAH” in the case of delaying or inability to pay.

27. Applicable laws and Jurisdiction:

27.1 The rights and the obligations referred to the mentioned parties shall undertakes the current terms and conditions and shall be explained and interpreted in accordance with the provisions and regulations of the Kingdom of Saudi Arabia, and the parties agree that any dispute, obligation or action of any kind arising under this agreement will be in the Kingdom of  ” Saudi Arabia  ” and the parties agree irrevocably in accordance with applicable laws and regulations in the Kingdom of Saudi Arabia that any dispute, obligation or action of any kind arising under this agreement, the prevailing party has the right to get the costs and lawyer’s charge from the non-prevailing party.

27.2 You hereby agree that you bear all possible consequences and (MIS Pay) is entitled, at its absolute discretion, to file a lawsuit through the Sharia Courts of the Kingdom of  ” Saudi Arabia  ” in the event of default or inability to repay.
